Terms of Service
Effective: April 29, 2026
1. Service
401kHunter ("the Service") is a software-as-a-service platform that helps financial advisors discover and analyze defined-contribution retirement plans using publicly-available U.S. Department of Labor Form 5500 filings, augmented with third-party-sourced contact information. The Service is provided on a subscription and pay-per-credit basis.
2. Eligibility
You must be at least 18 years old and authorized to enter into this agreement on behalf of any organization you represent. The Service is intended for licensed financial professionals and is not designed for use by retail investors or individuals seeking personal financial advice.
3. Subscriptions, credits, and billing
- Pro (monthly): $100/month, 150 credits granted at the start of each billing cycle.
- Pro (annual): $1,000/year, 1,800 credits granted upfront on subscription start.
- Credit packs: $1.00 per credit, granted immediately upon successful payment.
- Credits never expire and roll over from month to month.
- Subscriptions auto-renew at the end of each billing cycle until canceled. You may cancel at any time from your billing settings.
- Refunds: Subscription fees are not refundable for partial billing periods. Credits, once granted, are not refundable in cash. If a credit is consumed but the underlying lookup returns no usable data, the credit is automatically refunded to your balance per the Service's built-in refund logic.
- All payments are processed by Stripe; we do not store credit-card numbers.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state Do-Not-Call lists, or international privacy regulations (GDPR, etc.).
- Use contact information obtained through the Service for spam, harassment, or any communication that violates the recipient's legal rights.
- Resell, sublicense, or redistribute the Service's data to third parties without express written permission.
- Reverse-engineer, scrape, or systematically extract data from the Service beyond what is permitted by the API or export functions.
- Share your account credentials with anyone else.
5. Outreach compliance is your responsibility
Contact information surfaced by the Service includes phone numbers, email addresses, and other identifying details about plan administrators and decision-makers. Whether and how you contact those individuals is governed by laws and regulations including (but not limited to) the TCPA, CAN-SPAM, FINRA and SEC marketing rules, state-level Do-Not-Call regulations, and applicable privacy laws. You are solely responsible for ensuring your outreach activities comply with all applicable laws. The Service is a data provider, not a compliance tool.
6. Data accuracy
Plan filing data is sourced from publicly-available U.S. Department of Labor Form 5500 filings. These filings may contain errors, omissions, or be out of date. Decision-maker contact information is sourced from third-party providers (e.g., Apollo.io) and may be inaccurate, outdated, or refer to individuals no longer in the named role. The Service does not guarantee the accuracy, completeness, or timeliness of any data. See Data Disclaimers for details.
7. Not investment, legal, or fiduciary advice
The Service's fee grading (A–D), plan scorecards, insights, and other analytical outputs are simplified, automated calculations based on public data. They are not investment advice, legal advice, fiduciary recommendations, or solicitations to buy or sell any security or service. You agree to perform your own due diligence and consult appropriate licensed professionals before making any business or investment decision.
8. Intellectual property
Subject to your compliance with these Terms, you receive a non-exclusive, non-transferable, revocable license to use the Service during your subscription. Underlying software, design, and proprietary derivatives (scoring methodology, insights engine, etc.) remain owned by 401kHunter. Public-record DOL data is not owned by anyone and may be re-used in accordance with public-domain rules.
9. Termination
You may cancel your subscription at any time from your account page or by contacting support. We may suspend or terminate your account for violations of these Terms, fraudulent activity, or non-payment. On termination, your access ends at the end of the current billing cycle; we do not refund partial periods.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 401KHUNTER'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY.
12. Indemnification
You agree to indemnify and hold harmless 401kHunter from any claim arising from your use of the Service, your outreach activities, or your violation of these Terms or any applicable law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware.
